Conditions of participation in the "Design Hotel Valsana" competition on Instagram

This competition is not affiliated with Instagram and is in no way sponsored, endorsed or organised by Instagram. Instagram is not responsible for any of the content published as part of this promotion. The recipient of the information provided by the participant is not Instagram, but solely the company Diaqua AG (@diaqua_ch). Diaqua AG is exempt from any third-party claims in connection with this competition. All questions, comments or complaints about the competition should not be directed to Instagram, but to the organiser at
ecom@diaqua.com.
By participating in the competition, the user (hereinafter referred to as "participant") accepts these conditions of participation.
About the competition
Participation in the competition takes place via Instagram by fulfilling three conditions of participation. To take part in the competition, the following steps must be completed in accordance with the information in the Instagram post:
- Following the Diaqua AG Instagram account (@diaqua_ch)
- Tagging the desired companion on Instagram in the comments section of the competition post
- Sharing the competition post in the participant's Instagram story
Entry
The competition begins and ends as specified in the Instagram post on the diaqua_ch account. All natural persons resident in Switzerland who are at least 18 years old at the time of participation are eligible to participate.
Winner:in / Prize
The prize of the competition is a voucher worth 1000 Swiss francs for the Design Hotel Valsana in Arosa. The winner will be contacted via private message on Instagram by 22 January 2024 at the latest and must send the requested information for the voucher transfer via Instagram message within 48 hours. If the winner does not contact Diaqua AG via Instagram message within the 48-hour period, a new winner will be evaluated.
Legal recourse and cash payment of the prize are excluded.
Exclusion from participation
Employees of Diaqua AG and all persons involved in the conception and implementation of the campaign are excluded from participation. Competition organisations and automated competition services are not eligible to participate. Diaqua AG is entitled to exclude individual persons from participation if there are justified reasons, such as violation of the conditions of participation, attempted manipulation, etc., and reserves the right to take legal action.
Further information
- No Instagram account names of participants will be recorded or stored. Address data will only be collected from the person who wins and will only be used to send the prize. No data will be passed on to third parties.
- Diaqua AG reserves the right to adapt, change or cancel the conditions of participation if necessary.
- No correspondence will be entered into regarding the prize draw.
Salvatory clause
Should individual provisions of the conditions of participation be invalid or unenforceable, this shall not affect the validity of the remaining provisions. The ineffective or unenforceable provisions shall be replaced by effective and enforceable provisions whose effects come closest to the objective pursued by Diaqua AG.
Applicable law and place of jurisdiction
Swiss law is applicable. The exclusive place of jurisdiction is the Civil District Court of Basel-Landschaft West.
